We advocate replacing the Government. On its face, this sounds absurd. Yet, this right is advocated in the second paragraph of the Declaration of Independence.
The Founders thought of this right in terms of a principle emanating from “the Laws of Nature and of Nature’s God.” It is akin to the unalienable rights bestow upon all men (as in people) by the Creator.
Unalienable rights are non-negotiable divine rights given to men from God. Governments are instituted merely to insure these rights, not to bestow them. We are not civil society benefactors of a benevolent bureaucracy.
Our government has no unalienable rights. In fact, the framers argued that our government has no rights except those enumerated in the Constitution. The architects of the Republic made it clear that the authority of governmental bodies is limited to “deriving their just powers from the consent of the governed.”
What rights are we referring to? Life, liberty, and the pursuit of happiness.
…whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it and to institute new Government…
Clearly, the derivation of government’s power is from the people, the electorate, us!
A government that attempts to derive authority from internally generated sources is an unjust government, according to the Declaration of Independence. In such cases where the abuses of power become destructive to life, liberty and the pursuit of happiness (freedom, in essence), the people have the God-granted right to abolish such government. Our government derives its powers from the people, not the reverse.
This was the point of the Declaration of Independence. The people of America abolished the rule of unjust government, Britain, and did, in fact, institute a new government “of the people, by the people and for the people.”
Although it took a revolution to establish our initial government, there is no intent here to suggest or inspire insurrection of any kind. But, we as the electorate, the “people” as referred to in the Declaration, must, should and can institute new government.
